Manifestasi Unsur Negara Hukum (Rechtsstaat) dalam Pelaksanaan Perlindungan Hak Asasi Manusia Di Indonesia dan Pembangunan Masyarakat
Abstract
The protection of Human Rights in the context of the rule of law refers to the effort to ensure that the fundamental rights of individuals are recognized, respected, and upheld by the state in accordance with the applicable laws. This involves striking a balance between the government's authority and individual rights, so that the state operates in line with legal principles and the underlying human rights. This article explains the actualization of the elements of the rule of law (Rechtsstaat) in the implementation of human rights protection in Indonesia and also discusses the interaction between the principles of the rule of law and efforts to protect human rights. This research also provides an analysis of the context of the rule of law in Indonesia, examines policies and programs related to human rights protection, and presents case studies illustrating the implementation of the rule of law in the practice of human rights protection. Furthermore, this research assesses the relationship between the actualization of the rule of law and human rights protection, highlighting both successful and failed implementations in Indonesia to establish human rights protection in a rule of law state that can create a strong foundation for a fair, just, and democratic legal system. This not only supports an effective balance of power but also upholds the dignity and freedom of individuals in society.
